Protected Disclosures Act 26 of 2000

The broad vision of whistleblowing that is set out in the preamble of the Act linking the protection of whistleblowers to the realisation of the democratic values of human dignity, equality, freedom, transparent and accountable governance is not fully realised in the substance of the law which draws a limited protected boundary for whistleblowers in South Africa to “employees.”

While workplace whistleblowing is understood as vital in the fight against corruption and is legally protected in many other jurisdictions, most are widening the scope of workplace whistleblowing to cover anyone in a working relationship.
